Notice to state on officer’s plea

Chandigarh, November 26

In a cop versus cop case, the Punjab and Haryana High Court today put the state, Director-General of Police and IGP Kunwar Vijay Pratap Singh on notice on a petition filed by Assistant Inspector-General of Police Ashish Kapoor for quashing an FIR alleging unnatural offence.

The petitioner, in alternative, was seeking the transfer of investigation/inquiry to be conducted with regard to him from Kunwar Vijay Pratap Singh or any other officer under his supervision. The petitioner, through counsel Pradeep Virk, submitted he was having a blemish-free record except the present FIR registered on May 1 under Sections 377, 388, 389, 109, 115, 116 and 120-B of the IPC in Mohali.

Virk submitted on the petitioner’s behalf that the officer was being fallaciously indicted on the mere statement of a woman-convict. He added she had a previous criminal record and was out to avenge and harass the petitioner by tarnishing his reputation “for having refused to bow down to her illegal demands to misuse his position and help her in a case in which she was subsequently convicted”.

Virk submitted Kunwar Vijay Pratap Singh, to whom the investigation of complaint was marked/entrusted, was acting as the de facto complainant as he was making all efforts possible to establish the petitioner’s culpability. It was evident from the fact that the officer himself took the woman to various officers urging that petitioner had sexually exploited her. — TNS
