The Punjab and Haryana High Court has summoned Moga SP (Investigation) Harinder Pal Singh and two other police officials. The direction by Justice Rajbir Sehrawat came on an anticipatory bail plea in a case where the trial court proceedings were adjourned on 16 dates after police officers failed to appear as witnesses.

Justice Sehrawat had earlier directed that all police officers, witness in the drugs case, be taken in custody and kept in protective care of a jail till they were cross-examined. Justice Sehrawat had asserted the facts disclosed in the petition and orders passed by the trial court showed a “gloomy picture of police functioning” and its “indifferent conduct” towards the proceedings.

Justice Sehrawat had observed “surprisingly” the warrants issued by the trial court against the police officers, too, were not executed. The Station House Officer of Kot Ise Khan police station in Moga district was also directed to remain present with detail of police officials who failed to execute the warrants even though they were entrusted with the duty.

The directions came on an anticipatory bail petition by Kakka Singh against Punjab in a case registered on April 2, 2016, under the provisions of the NDPS Act at Kot Ise Khan police station.

Sub-Inspector Amarjit Singh said no summons or warrants issued by the court were received or remained unexecuted during his tenure as the SHO. He said the summons and warrants earlier issued against the officials were entrusted to Constable Pawan Kumar. However, he did not effect the service of those warrants. He submitted that he was not the SHO of the police station concerned during that period.
