HC raps cops over shoddy probe

The Punjab and Haryana High Court has virtually rapped the investigating agency probing a criminal case for its shoddy approach. The admonition came after the Bench took note of the fact that the Punjab Police failed to file X-ray films to establish injuries sustained by the complainant, while presenting final report in the case.

The censure by Justice Anil Kshetarpal came on a petition filed against the state government and other respondents by complainant Avtar Singh through counsel Sarvesh Kumar Gupta and Ram Bilas Gupta. Justice Kshetarpal asserted: “The petition presents a sorry state of affairs in the investigating agency. While presenting final report, X-ray films to prove the injuries and fractures were not filed. In the reply, this fact is not disputed.”

Justice Kshetarpal directed Hoshiarpur SSP to file an affidavit within 15 days on action he proposed to initiate in the matter.

Justice Kshetarpal also made it clear that failure to comply with the order would entail the officer’s presence in the court on the date fixed. The case will now come up for hearing after the HCreopens following the Dasehra break.

In his plea, Avtar Singh was seeking directions to the state and other respondents to take immediate action against an ASI and a head constable for not attaching X-ray films of the petitioner with the challan. This, the petitioner alleged, was done knowingly and deliberately to help the accused.
