HC turns down bail plea in gold smuggling racket

The Punjab and Haryana High Court has refused anticipatory bail to an alleged “kingpin” of a gold smuggling racket after observing that the authorities need deep probe and custodial interrogation of the petitioner.

The order by Justice Arvind Singh Sangwan came on a petition filed by Rakesh Rai against Customs and Central Excise Department. He was seeking anticipatory bail in a case registered under Section 135 of the Customs Act. Counsel for the respondent had submitted that the petitioner, along with his son and others, was running a racket and the market value of the smuggled gold was more than Rs 1 crore. He added that there was a provision for imprisonment, which may extend to seven years under Section 135 of the Act. As such, the anticipatory bail of the petitioner may be dismissed.

After hearing the counsel for the parties, Justice Sangwan asserted that the court did not find ground to grant anticipatory bail to the petitioner. Referring to the investigation, Justice Sangwan added it had come on record that the accused persons, on more than four occasions, in conspiracy with each other, brought gold in an illegal manner, making the offence non-bailable.

He said the allegations against the petitioner was the financer, who had provided $33,000 to the co-accused for purchase of 1 kg gold. It was brought from Dubai to Amritsar, where it was seized.

“In view of the above, considering the serious allegations against the petitioner, I find no ground to grant anticipatory bail to the petitioner,” Justice Sangwan added, while dismissing the plea.
