Fake encounter: DGP to continue inquiry

Just about four months after DGP Siddharth Chattopadhyay claimed non-availability of basic facilities for looking into a fake encounter case, the Punjab and Haryana High Court today made it clear that the officer would continue with the probe.

As the case came up for resumed hearing before Justice Arun Monga, counsel appearing for Chattopadhyay submitted that the officer was senior to Punjab DGP Dinkar Gupta. As such, he could not represent or present report to the DGP.

Taking a note of the submissions, Justice Monga asserted that the government and Chattopadhyay would directly communicate with Punjab Home Secretary. He would, as such, be provided infrastructure for the probe.

Chattopadhyay, who had sought requisite powers and facilities to probe the issue, earlier suggested that he may, alternatively, be given a mainline posting. The officer, on the previous date of hearing, had stated that he had been posted outside the main stream and outside the regular state police service. As such, he would require necessary powers, appropriate office with supporting officers, and staff, along with necessary transport and office facilities, to conduct the investigation.

The direction by Justice Monga came in connection with a petition filed in 2013 by victim Sukhpal Singh’s wife Dalbir Kaur and his father Jagir Singh of Kala Afghana village. They had alleged that Sukhpal Singh was killed in an encounter, but “militant” Gurnam Singh Bandala alias Neela Tara, who was shown to have been killed. The Bench was told that Bandala, reportedly killed in the police encounter in 1994, was later caught alive.

Alleging attempts by the state to shield the guilty, petitioner’s counsel R. Kartikeya had added that inquiry was not initiated to determine the truth about the fake encounter, which was stage-managed by then DSP Paramraj Singh Umaranangal.
