Registration of illegal floors continues, officials unmoved

Call it lack of coordination between the Local Government and the Revenue Departments or politician-official-builder nexus, the registration of illegally constructed independent floors on individual plots continues unabated.

Such floors are being constructed by builders in Zirakpur, Mohali, Kharar, Ludhiana and others towns.

Instead of giving details of the area-specific builder colony, the collector rates simply mention the name of the village and floor-wise registration rates. In case of Ziarkpur and Kharar municipal bodies, the executive officer (EO) concerned is signatory to the collector rates notification. The sale deeds of such illegal independent floors are being registered without the revenue authorities asking for the building plan approval.

As a result, recent instructions issued by the Directorate, Local Government, to its field staff to check builders who are illegally selling independent floors against getting approval for a colony in the form of plotted development with fixed floor area ratio (FAR) has done little on the ground. Politicians, be it of the Congress or the SAD have stakes in illegal colonies. Gurvinder Lamba, general secretary, Punjab Colonisers and Property Dealers’ Association, said the problem of independent floors was more rampant around Chandigarh. “Instead of targeting builders, the government should find out a practical solution as lot of public money was involved”.

Even after the department issued instructions last month stating that the construction of stilt plus three floors or ground plus three floors on individual plots was violation of the Punjab Municipal Building Bylaws 2018, the promoters are getting the plans sanctioned in the back date with the connivance of the officials concerned. A vigilance probe into the illegal construction of independent floors during the regime of the then Local Government Minister Navjot Singh Sidhu is learnt to have also indicated towards the illegal activity.

But the government has not taken any action on the vigilance probe report. Instead, the department has issued instructions to its field staff to check the violations and act against such builders.

“It has brought to the notice of government that after getting licence from the competent authority for a colony in the form of plotted development, some builders construct stilt plus three floor or ground plus three floors in violation of the building bylaws. In some cases, the builder gets the plan sanctioned for a row of contiguous units by showing each as separate unit whereas in reality, they are part of a larger project,” reads the letter issued by the Director, Local Government. “There are inherent flaws in the municipal laws. These allow the builders to construct independent floors by getting the plans of houses approved. The ground coverage of houses of up to 150 sq m has been increased to 90 per cent. The FAR was increased to 1:2.00 and the maximum height permissible was increased to 50 ft. These all provisions were in direct conflict with the national building code 2005. These provisions were created to give backdoor entry to independent floors,” admitted an official.

Officials blame collector rates
