HC commutes death sentence to life term

Just about three months after a 42-year-old man was sentenced to dead for shooting a schoolteacher, the convict has escaped the gallows. The Punjab and Haryana High Court has ruled that the case did not fall within the ambit of rarest of the rare, while commuting the death sentence to life imprisonment.

The Bench of Justice Rajiv Sharma and Justice Gurvinder Singh Gill asserted that the appellant would have to mandatorily serve minimum 20 years without remission and pay Rs 20, 000. The ruling came on an appeal preferred by appellant Makhan Singh against the order passed by the Mansa Sessions Judge, whereby he was sentenced to death.

The Bench asserted that the prosecution had proved that appellant Makhan Singh had fired two shots at Simarjit Kaur, who died on the spot. The Bench also took note of the submission that the motive attributed to Makhan Singh was that family of victim Simarjit Kaur was not happy with her love marriage.

Teacher’s murder

The Punjab and Haryana High Court ruled that the case did not fall within the ambit of the rarest of the rare, while commuting the death sentence to life imprisonment.
