Cop ‘guilty’ of framing man, raping his wife

A CBI probe has “established” that a Jalandhar man was not only falsely implicated in a drugs case, but an ASI demanded and accepted Rs 50,000 from his wife as illegal gratification for not registering a criminal case and also raped her.

When the accused moved the Punjab and Haryana High Court after eight months in jail and his wife’s alleged rape by the money-demanding investigating officer, the best he hoped for was bail. But Justice Rajan Gupta of the High Court ordered a CBI probe after the Bench was told that the same officer, ASI Gyan Ishwar, had poured acid in the mouth of another accused following his refusal to admit his role in contraband smuggling.

The petitioner-accused, name withheld to protect his wife’s identity, was seeking regular bail in a case registered against him on August 12, 2017, under the NDPS Act at Maqsudan police station in Jalandhar. The police had claimed that the accused was found in possession of 160 grams of intoxicant power containing alprazolam.

During the course of hearing, his counsel referred to the petition to submit that the ASI concerned started demanding money from his wife after implicating him in the case. The officer also started visiting the petitioner’s house before harassing his wife. “Ultimately, he raped her,” he added.

As the case came up for resumed hearing, Justice GS Gill observed an application seeking the discharge of the accused in the case had already been filed before the Special Court. Consequently, his bail application was also accepted. Justice Gill added that a status report filed by the CBI had added that a chargesheet for criminal conspiracy, false evidence and other offences under Sections 120-B 193, 195, 211 and 218 of the IPC had also been filed in the court of CBI Special Judge against Gyan Ishwar.

The chargesheet also mentioned that ASI Gyan Ishwar had also committed offences punishable under the provisions of the Prevention of Corruption Act, along with rape and other offences under Section 354-A, 376 and 506 IPC.

The report added that a separate FIR had been registered against Gyan Ishwar in the acid pouring case. “The CBI is directed to expedite the investigation in the acid pouring matter so that a final report is submitted at the earliest,” Justice Gill added.
