Accused of contempt, man jailed for 30 days

The Punjab and Haryana High Court has sentenced a Jalandhar resident to 30 days simple imprisonment after holding him guilty of willful contempt of court. The contemnor had failed to honour his undertaking before the court on paying money back to a bank.

The order by Justice Nirmaljit Kaur came on a petition filed against Kamaljit Shoor by Jalandhar Citizen Urban Cooperative Bank Ltd. through counsel Ashwani Prashar. The petition was filed for violation of order dated July 30, 2013, vide with the matter before the court was disposed of in view of a statement made by the respondent that he would Rs 5 lakh within a month and the remaining Rs 31,55,861 within eight months thereafter. Some amount was paid over a period of time, but the arrears remained.

Justice Nirmaljit Kaur asserted that the respondent was only misleading the court and found him guilty of the contempt of court.

Justice Nirmaljit Kaur added: “It is apparent that the respondent has no intention to pay the amount as ordered and as undertaken by him to do so. He is, thus, held guilty of willful contempt.”

On the issue of quantum of sentence, Justice Nirmaljit Kaur observed that the respondent’s contention before the court was that his brothers were in hospital and he would not be in a position to arrange the money, if he went in custody.

Before parting with the case, Justice Nirmaljit Kaur asserted the Court deemed it appropriate to sentence the respondent to undergo simple imprisonment of only 30 days, taking into account the facts and circumstances of the case.
